This case was settled for the at fault driver's insurance policy limits. Young driver rear ended our client, a Cherokee County resident, causing a sprained thumb and neck. The impact was not severe but the case was successfully pursued because the defendant left the scene of the wreck and was found a few days later. His story that he thought he was free to leave was not credible. Before a lawsuit was filed, the most that was offered was $4,000.00 and the insurance company made it clear that they would defend the case vigorously. After depositions, we added a claim for attorney's fees and costs for bad faith and stubborn litigiousness and for hit and run. Policy limits of $25,000.00 were paid after the plaintiff filed an offer of settlement.
