Plaintiff lost his wife and three-year-old child in this tragic one-car accident caused by his wife’s negligence in driving off the road on a clear dry day with non-prescribed controlled substances in her bloodstream. Recovery was able to be made for the wrongful death of the child under the insurance policy of the van being driven because it was a friend’s van and intra-spousal immunity was avoided due to the wife’s death. Investigation into the local and state DOT’s potential responsibility for the deaths proved to be fruitless due to certain immunity issues.
