- The defendant owed you a duty of care;
- The defendant breached, or broke, this duty;
- The breach caused your injury; and
- You incurred recoverable damages from the injury.
When all of the evidence has been assembled, and/or you have fully recovered from your injuries/received a full prognosis, your attorney will present a settlement package to the insurer which will include the cause of negligence by their client, and the full amount of damages you suffered as a result of the accident.
If the insurer agrees to the amount, you may choose to settle the case and you will receive your compensation. If not, your Fayette injury lawyer will usually file a lawsuit on your behalf.
