Plaintiff was driving a four-door sedan in a commercial area on a bridge over I-285. He stopped for a red traffic signal and was rear-ended by a tractor trailer truck driven by Defendant. Defendant was employed by co-defendant trucking company. Plaintiff alleged permanent disability as a result of his neck injury, which required surgery. He was assigned a 31% permanent partial disability rating and argued that his future earnings would be diminished because of his injury. He sought $69,883 in medicals and $484,000 in future lost income for diminution of earning capacity. The parties settled the claim for $250,000 prior to trial on 1/15/2009.
