In 2005, an attempt at tort reform led to the passage of a series of laws, one of which pertained specifically to medical malpractice damages. This new law was a noneconomic damage cap that imposed a maximum limit of $350,000. This means that even if a jury awarded $1 million (or more) in noneconomic damages for an injured plaintiff, the award would be automatically be reduced to $350,000, plus additional economic damages for medical costs, lost wages and so on.

Fortunately for patient-victims, the system’s integrity was restored just 5 years later in 2010, when the Georgia Supreme Court struck down the law, ruling to uphold a $1.265 million jury award to a woman whose routine face-lift surgery ended tragically and left her with serious injuries that required extended treatment and resulted in permanent disfigurement.
