How long must a child use a car safety seat in Georgia?

 

A: According to Georgia's child safety seat law, all children under 6 years of age who ride in a motor vehicle must be placed in a child seat in Georgia while riding on a public road. This applies to all vehicles on Georgia roadways except for taxi cabs and public transportation vehicles.

There are certain circumstances under which a child is not required to use a child seat in Georgia.

These circumstances include:
 

  • When a child is 40 or more pounds - a lap belt may be used if the vehicle is not furnished with both a lap and shoulder belt.
  • When a child is taller than 4'9" - this requires the use of a safety belt.
  • When there are no more lap or seat belts - this occurs when all the other lap and seat belts are occupied by other children. 

Georgia's child safety seat law also stipulates that children must be seated in the rear seat.

The exceptions to this include situations in which:
 

  • there is no rear seat in the motor vehicle;
  • all of the rear seats are occupied by other children; or
  • the manufacturer's instructions indicate that a child in the front seat must be properly restrained in a specific seat. 

In addition to these laws, Georgia's child safety seat law stipulates that all minor children who are 6 years or older must be restrained by a safety belt.
