Cash settlement prior to trial. Seventy-five (75) year old retired mother and grandmother of three was killed by a tractor-trailer that drove through the median on I-75 southbound directly into oncoming northbound traffic.
Jury Verdict. Plaintiff was driving a tractor-trailer for his employer Dekalb County in a landfill when he was struck by a garbage truck in the front left of the tractor. Plaintiff suffered a blunt chest injury which required a rib excision and ultimately necessitated an implant of an electrical stimulator to deaden the chronic and permanent nerve pain in his chest wall.
Cash settlement prior to trial. Plaintiff, a Chinese-American, struck the side of a tractor-trailer that was attempting to make a left turn in front of him at an intersection. Plaintiff suffered multiple bruises, soft tissue neck injuries with cervical disc herniation and a compression fracture of the C3 vertebrae. Defendant contended that plaintiff could have avoided the collision if he had been paying attention.
Jury verdict. The plaintiff's decedent, a forty-three (43) year old homemaker, was killed after her vehicle was struck by a tractor-trailer in a rural south Georgia town.
Cash settlement at mediation. The plaintiff, who was a truck driver, was pulled off the side of the highway sleeping when he was struck from behind by another tractor-trailer rig. Plaintiff suffered a herniated disc in his low back which required surgery.
Cash settlement at trial. In this case, a tractor trailer truck collided with the rear of the plaintiff's vehicle causing soft tissue injuries.
Cash settlement prior to trial. The plaintiff sustained soft tissue neck and back injuries after a tractor trailer caused a chain reaction rear-end collision.
Cash settlement prior to trial. The plaintiff suffered soft tissue neck and back injuries after being side-swiped by a tractor trailer truck.
Cash settlement at mediation. Plaintiff, a Georgia truck driver, was rear ended near a truck stop at the end of an exit ramp by another Georgia truck driver in Kentucky. The only damage to the trailer of the lead truck was to the rear underride guard. Plaintiff suffered a neck injury which required surgery, the cause of which was hotly contested.
Cash settlement at mediation. Plaintiff was injured when a truck with faulty brakes sideswiped her after being unable to stop for traffic. Plaintiff had arthoscopic shoulder surgery for a “torn”rotator cuff but it was questionable whether the sideswipe caused that injury given the previous medical history and complaints of shoulder pain and problems pre-existing the incident.
Cash settlement prior to trial. Plaintiff was driving north on I-75 near Macon when he was sideswiped by a tractor-trailer and injured. Plaintiff suffered an aggravation of a previous knee injury which required arthoscopic surgery and also suffered soft tissue neck and back injuries.
Cash settlement prior to trial. Plaintiff was a forty (40) year old waitress who suffered a clavicle fracture and a severed nerve in her pinky finger from embedded glass. Plaintiff had $14,262.34 in medical expenses and also witnessed her best friend’s death in the wreck. The case was settled before the court ruled on whether Plaintiff could recover for the emotional distress of witnessing her best friend’s death.
Cash settlement prior to trial. Plaintiff was a forty-seven (47) year old insulator who suffered multiple broken bones in a collision with a dump truck, including a fractured tibial plateau, fractured hip and fractured ulna. Plaintiff underwent three surgeries on his ulna and one each on the knee and hip.
Cash settlement at mediation. Plaintiff was a seventy-six (76) year old female who suffered a hip fracture and underwent a total hip replacement after being involved in a collision with a tractor-trailer.
Cash settlement at mediation. Plaintiff was a fifty-seven (57) year old truck driver who had two knee replacement surgeries after being injured while opening his trailer doors due to a negligently secured load of Honey Nut Cheerios.
Jury Verdict. Plaintiff, who was riding a motorcycle on an interstate highway, was struck by an improperly secured truck tire that had fallen off a bobtail tractor. Plaintiff required dental work, rotator cuff surgery, discectomy and instrumented fusion involving three lumbar vertebrae.
Jury Verdict. Plaintiff suffered multiple injuries, including a Grade III complex fracture of his left tibia and fibula, multiple fractures in the bones of the foot and ankle and torn ligaments in his left hand and wrist, all requiring surgery both emergently and over the year following the wreck. Plaintiff was riding a Harley Davidson motorcycle and was struck head on by a young parts driver for AutoNation who claimed that dust particles flew into his eyes just before crossing the centerline.
Cash settlement at mediation. Plaintiff suffered multiple injuries, including a ruptured spleen, fractured hip requiring hip replacement and several other surgical procedures to repair soft tissue injuries to his knee and elbow after he was struck by a Gwinnett County construction vehicle that had crossed the centerline in the rain on a sharp curve.
Jury Verdict. Plaintiff was rear ended causing no visible damage ($600) to her Jeep Cherokee. She later had carpal tunnel surgery on both wrists. State Farm offered $0 before trial, $15,000 the first day of trial, and hired an orthopedic surgeon and a neurologist to testify at trial for the defendant.
Cash settlement prior to suit. Plaintiff and his seven (7) year old son were struck from behind by a woman who was driving under the influence of alcohol. This was her 2nd offense in the past three years. Son had a $660 emergency room bill and father suffered soft tissue neck and back injuries and had $2,500 in medical expenses. The policy limits where $25,000 per person and the case was settled for $22,500 each.
Cash settlement prior to suit. Plaintiff was a female college student involved in a car wreck. She had prior ACL knee injury, but had substantially recovered from that injury until she was involved in this car wreck. She underwent an ACL reconstruction and partial lateral meniscectomy. Plaintiff had $27,764 in medical expenses and was able to recover under four separate “stacked” uninsured motorist policies of $25,000 each on her parents vehicles.
Cash settlement at mediation. Plaintiff had arthoscopic knee surgery following a car wreck caused by a nineteen year old first time DUI offender.
Cash settlement during trial. Plaintiff was injured in a rear end automobile wreck and suffered injury to her right sacroiliac joint. She ultimately required fixation of the joint involving screws placed through her sacrum and hip bone.
Cash settlement at mediation. Plaintiff’s husband was traveling in South Georgia on an interstate highway during a rainstorm en route to visit family in North Carolina. His vehicle suddenly struck a large accumulation of water on the road, causing the vehicle to spin out of control, across the center median and headon into an 18-wheel tractor-trailer traveling in the opposite direction. Plaintiff’s husband was killed. Plaintiff alleged faulty design and maintenance of the roadway, claims which were supported by prior incidents at the same location.
Cash settlement prior to suit. Plaintiff was a thirty seven (37) year old woman who was struck from behind by a company van on I-75. Plaintiff underwent neck surgery fusing three vertebrae. Plaintiff had a long history of neck problems prior to the wreck.
Cash settlement prior to suit. Plaintiff lost his wife and three-year-old child in this tragic one-car accident caused by his wife’s negligence in driving off the road on a clear dry day with non-prescribed controlled substances in her bloodstream. Recovery was able to be made for the wrongful death of the child under the insurance policy of the van being driven because it was a friend’s van and intra-spousal immunity was avoided due to the wife’s death. Investigation into the local and state DOT’s potential responsibility for the deaths proved to be fruitless due to certain immunity issues.
Cash settlement prior to trial. The plaintiff was exceeding the speed limit on a motorcycle when a car turned left in front of him, causing multiple fractures to his hand, ribs, and foot. Policy limits were only $100,000.
Cash settlement prior to trial. The plaintiff, who had a prior history of neck pain, suffered mild disc herniation and soft tissue injuries in her neck after a collision caused by the defendant's negligence.
Cash settlement of policy limits prior to suit. The plaintiff was riding a bicycle and was struck by a car making an improper left turn. The plaintiff suffered a herniated disc in his neck.
Cash settlement prior to trial. The plaintiff was a passenger in her friend's car when another vehicle attempted to make a left turn in front of them at an intersection. The plaintiff suffered a fractured left femur.
Cash settlement at mediation. The plaintiff was rear ended by a twenty (20) year old college student in downtown Atlanta on the connector and suffered soft tissue injuries to her neck and back.
Cash settlement prior to trial. The plaintiff was involved in a T-bone collision with a pick up truck pulling a commercial chipper when the truck ran a stop sign. Plaintiff suffered soft tissue neck, back and knee injuries.
Cash settlement prior to suit. Plaintiff was passenger in the back seat of a small passenger car that rear ended another car on Interstate I-285 in a multiple car chain reaction collision. He suffered a separated pelvis which required surgery and low back soft tissue injuries. The policy limits of $100,000 were obtained three months after the wreck.
Cash settlement prior to trial. Plaintiff and her minor son were sideswiped after traveling through an intersection. Plaintiff and her minor son had less than $3,000 in combined medical expenses. The defendant driver, who was seventeen at the time, tested positive for marijuana use.
Cash settlement prior to suit. Plaintiff was rear ended by an sixteen (16) year old boy driving out of state family friend’s van. Plaintiff had a herniated disc in his low back which required surgery. We were able to “stack” two separate policies of insurance for a combined $100,000.
Jury Verdict. Plaintiff landscaper was rear ended causing $200 in property damage to his Ford F-150 pick up truck. He later had surgery on his low back. The most offered by State Farm before trial was $500.
Cash settlement prior to suit -- 1998. Two plaintiffs were rear-ended by a drunk driver and suffered soft tissue neck and back injuries and each incurred approximately $2,000 in medical expense.
Cash settlement prior to trial. Plaintiff was a sixty one (61) year old woman who was struck head on by a twenty (20) year old driver who claimed to have hydroplaned and lost control. Plaintiff underwent neck surgery fusing three vertebra and also suffered permanent scarring and deformity to her right breast from the seatbelt. Plaintiff had a great deal of pre-existing symptomatic neck problems prior to the wreck.
Cash settlement prior to trial. Plaintiff was rear-ended by defendant at a stop light, totaling the plaintiff’s car. Plaintiff suffered an aggravation of her pre-existing rare arthritic condition that required ongoing treatments for her neck and back pain. There was only $100,000 in available liability insurance coverage.
Confidential settlement at mediation. R.H. v. [Hospital] and [Doctor] Superior Court of Dekalb County, Decatur, Georgia. Plaintiff had a c-section for the birth of her son and a laparotomy pad (sponge) was inadvertently left inside her abdomen by the surgeon and OR nursing staff. Plaintiff suffered an abdominal abscess that required draining on two occasions including the removal of the pad via laparoscopic surgery.
Confidential cash settlement at mediation. [ ] v.[ ] Laboratory and [ ] OB-GYN, M.D. Superior Court of Muscogee County, Georgia. Laboratory misread PAP smear of thirty two (32) year old mother of three and OB-GYN failed to diagnose cervical cancer and perform appropriate follow up after suspicious biopsies and PAP smears. Patient underwent chemotherapy and radiation and is currently in clinical remission.
Confidential cash settlement at mediation. [ ] v.[ ] Medical Center, Inc. and [ ] Emergency Group, P.C. Superior Court of Dekalb County, Georgia. Atlanta area hospital negligently released fifteen (15) year old patient who later died from injuries suffered in a car accident a few hours earlier
.Confidential settlement at mediation. Estate of John Doe v. XYZ Hospital, John Smith, M.D., ABC Radiology. Plaintiffs settled claim against two of three defendants at mediation for medical negligence as the result of the retention of a foreign body (lap sponge) during surgery.
Cash settlement at mediation. Plaintiff was delivering food/drinks for the Delta Crown rooms at the airport. After the delivery and while backing onto the freight elevator, the gate slammed down on his head. Discovery revealed that years before, the “safety edge” had been disabled in favor of an “eye” inside the cab of the elevator but not on every floor which created the hazard that lead to the incident. Plaintiff suffered soft tissue neck and back injuries.
Cash settlement prior to trial. The plaintiff suffered back and knee injuries after a bench outside the Sears Roebuck and Co. automotive department collapsed as she sat on it.
Cash settlement at mediation. Plaintiff was an eleven (11) year old girl who was wrongfully accused of shoplifting and physically detained by a large unidentified male, who later identified himself as a security officer. Plaintiff had $1,890.00 in psychological counseling care as a result.
Cash settlement prior to trial. Plaintiff was in the Autozone buying some oil for his tractor early one morning when he slipped on the floor on a slippery substance. Discoveryrevealed a “spill” of battery terminal protectant (silicone substance) was allegedly cleaned up the night before after the store was closed. Discovery also revealed that it was likely that the “spill” was not properly cleaned in accordance with the MSDS. Plaintiff suffered back and sacroiliac joint injuries requiring surgery.
Cash settlement at mediation. Sixty-nine (69) year old man, flying Delta with a connecting flight in Atlanta, was thrown from an electric cart at Hartsfield Airport and suffered a comminuted fracture of his left femur. The left femur fracture further compromised his ability to ambulate independently.
Cash settlement prior to trial. Plaintiff was shot in the leg by his ex-wife’s boyfriend on the doorstep to her apartment. The defendant boyfriend was convicted and sentenced to twenty years in prison. Half of the recovery was from defendant’s insurer that had an exclusion from coverage for intentional acts in the policy.
